Emma Vs Lynda - Similar logos! Passing off??

For years I have been using Lynda.com as a source of training and insight into many things.

At first I thought the branding that was done for Lynda was similar to the leaning books for Dummies - IE "How to play the Guitar for Dummies" etc etc. The yellow and black were very similar.

Today I have stumbled across another site, but this time I think that the logo is very similar to Lynda.com...

Emma (www.myemma.com)

I found it by seeing this advert and clicking to see what it was all about - thinking that this was a spin off from Lynda.com as it used similar coloring (orange is not yellow I know), and a female name as the company name.

The logos of these two companies are very similar in style and colours...

...but is there also anything similar about the names of the companies? Lynda ... Emma?

I am no lawyer or intellectual property expert, but could this be another case of passing off?

This is passing off. A method that supermarkets have been abusing for a while now. Create your own product then brand it similar to the product that has been established and successful. This link explains my point...

'Emma' could well be a superb service and should create it's own identity but by making it so similar to Lynda cheapens it. In my opinion. Anyway, I'm working on my new software Abode Photoshack :o)

Don't see it. Who's going to go looking for Lynda.com and "stumble" on MyEmma.com? Yes, the logos are in the same graphic galaxy, but they don't really convey the same message (bright & attentive vs. contemplative & studious). The overall similarities are worth mention, but not in the same breath as passing off. "The first thing we do, let's kill all the lawyers".

I do see where your coming from with this, Lynda could almost be a profile shot of Emma though I know Lynda was around first. But there are so many similar logos lease days it is hard to be original and easy to be too close to an existing logo by accident!
